NOVAJEEPERS.COM referred to as the "Site", or the “forum”

Please read these Terms and Conditions carefully!

These Terms and Conditions include our policy for acceptable use of the Site and content posted on the Site, your rights, obligations and restrictions regarding your use of the Site.

By accessing this Site, you accept, without limitation or qualification, the following Terms and Conditions. You are only authorized to use the Site and its services if you agree to abide by all applicable laws and to these Terms and Conditions. If you do NOT accept the Terms and Conditions, then you must discontinue your use of the Site.

We may modify these Terms and Conditions from time to time and such modification shall be effective upon posting on the Site. You agree to be bound to any changes to these Terms and Conditions when you use the Site after any such modification is posted. It is important that you review these Terms and conditions regularly to ensure you are updated as to any changes made. These Terms and Conditions constitute the entire agreement regarding your use of the Site and the services it offers and supersede any such prior terms. If any future changes are not acceptable to you, then you must discontinue your use of the Site. YOUR CONTINUED USE OF THE SITE WILL ALWAYS INDICATE YOUR ACCEPTANCE OF THIS AGREEMENT AND ANY CHANGES TO IT.

Purpose of the Forum

The NOVA Jeepers forum serves as the primary communication means for NOVA Jeepers members, and the community to engage activities to promote fellowship, education, recreation, and awareness of issues critical to outdoor activities. Discussions should encourage Jeep enthusiasts young and old, to engage in activities off-road and on, and to bring the joy of the outdoors to our members, our families, and our communities.

This is a Civilized Place for Public Discussion

Please treat this discussion forum with respect. It’s a shared community resource — a place to share skills, knowledge.

Help us make this a great place for discussion by always working to improve the discussion in some way, however small. If you are not sure your post adds to the conversation, think over what you want to say and try again later.

The topics discussed here matter to us, and we want you to act as if they matter to you, too. Be respectful of the topics and the people discussing them, even if you disagree with some of what is being said.

One way to improve the discussion is by discovering ones that are already happening. Please spend some time browsing the topics here before replying or starting your own, and you’ll have a better chance of meeting others who share your interests.

Be Respectful, Even When You Disagree

You may wish to respond to something by disagreeing with it. That’s fine. But, remember to criticize ideas, not people. Please avoid:

  • Name-calling.
  • Ad hominem attacks (explained here
  • Responding to a post’s tone instead of its actual content. Studies show that people tend to believe that they can communicate over electronic means more effectively than they actually can.
  • Knee-jerk contradiction.
  • Personal attacks
  • Instead, help improve the conversation. Criticism when used correctly, is good for creativity - so criticize ideas, and not people.

If You See a Problem, Flag It

Moderators have special authority; they are responsible for this forum. But so are you. With your help, moderators can be community facilitators, not just janitors or police.

When you see bad behavior, don’t reply (Don't feed the trolls). It encourages bad behavior by acknowledging it, consumes your energy, and wastes everyone’s time. Just Report It. If enough reports accrue, action will be taken, either automatically or by moderator intervention.

Always Be Civil

Nothing sabotages a healthy conversation like rudeness:

  • Be civil. Don’t post anything that a reasonable person would consider offensive, abusive, or hate speech.
  • Keep it clean. Don’t post anything obscene, sexually explicit, vulgar, racially, ethnically or otherwise, objectionable
  • Respect each other. Don’t harass, intimidate, grief or impersonate people, or expose their private information. Don’t post libelous, defamatory or otherwise tortious language.
  • Keep it legal. Do not post or distribute content promoting illegal content or make available any materials or information infringing on the rights of a third party.
  • Respect our forum, and our community. Don’t post spam or otherwise vandalize the forum.

These are not concrete terms with precise definitions — avoid even the appearance of any of these things. If you’re unsure, ask yourself how you would feel if your post was featured on the front page of your local newspaper.

This is a public forum and reflects our club and the Jeeping community. Search engines index these discussions. Keep the language, links, and images safe.

Violations

Northern Virginia Jeepers Association operates a warning based policy for all forum users and club members. Continued display on the forum of prohibited behavior will result in actions by the Website Committee, Officers, or BOD.

Offending individuals will receive a single "warning point" that expires 5 years after the warning is issued. As warnings accumulate, the following actions will be taken:

  • After a single warning, a message will be sent to the offending individual outlining the inappropriate behavior and notifying that a warning has been issued.
  • After 2 warnings, a two week temporary ban will be automatically applied
  • After 3 warnings, a one month temporary ban will be automatically applied
  • After 4 warnings, a permanent ban will be automatically applied

Users who feel they have been unfairly warned are welcome to contact the relevant persons by personal message. If you feel the warning was unfair you may appeal to an Officer or a member of the BOD. Their decision is final.

Any attempt to circumvent a temporary ban will lead to that ban being made permanent. Circumvention includes re-registering under a non-banned username, changing IP addresses to evade an IP ban, or registering a new email account to evade an email ban. Circumvention also includes posting as another user.

CONTENT

We do not prescreen information submitted by users of the Site ("Submission"). The Site retains the right, but not the responsibility, to edit or remove any Submission, including those deemed by the Site to violate the Agreement. The Site will make good faith efforts to investigate allegations that Submissions violate the Agreement but (a) makes no warranty to you that it will edit, remove, or continue to permit the display of any specific Submission, whether or not subject to such allegations, and (b) will have no liability whatsoever for editing, removing, or continuing to permit the display of any Submission whatsoever.

All content you submit, upload, or otherwise make available to the Service ("Content") may be reviewed by moderators. All Content you submit or upload may be sent to third-party verification services (including, but not limited to, spam prevention services). Do not submit any Content that you consider to be private or confidential.

We may remove or modify any Content submitted at any time, with or without cause, with or without notice. Requests for Content to be removed or modified will be undertaken only at our discretion. We may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice.

STORAGE

You agree that the Site has no responsibility or liability for the deletion of, or the failure to store or to transmit, any content and other communications maintained by the Site. The Site retains the right to create limits on use and storage at our sole discretion at any time with or without notice.

INDEMNITY

You agree to indemnify and hold us, and our subsidiaries, affiliates, directors, officers, agents, vendors or other partners and employees harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of any material or information posted, provided, transmitted or otherwise made available by you on the Site or through the Site's services, or by your violation of these Terms and Conditions, or by your violation of the rights of another.

DISCLAIMERS AND LIMITATION OF LIABILITY

You understand and agree that the Site is provided "As-Is" and that we assume no responsibility for your ability to (or any costs or fees associated with your ability to) obtain access to the Site. Nor do we assume any liability for the failure to store or maintain any user communications or personal settings.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SITE OR THROUGH OR FROM ITS SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS AND CONDITIONS.

IN NO EVENT SHALL THE SITE OR ITS OWNER BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SITE OR ITS SERVICES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
